  • TSC Future of financial services regulation

    TSC has published its wide-ranging report which sets out a number of conclusions and recommendations/conclusions with regard to the roles of... HMT, FCA and PRA. Amongst other matters, TSC urges the Government to make progress on mutual recognition as an element in any free trade agreement. TSC recommends that there should be a secondary objective for FCA and PRA to promote long-term economic growth, recommends that HMT requires FCA to have regard for financial inclusion in its rule-making, sets out recommendations concerning regulatory costs, and sets out concerns on FCA’s service standards and the authorisation process. With regard to the Solvency II review, TSC suggests that PRA should consider where there is more that can be done to reduce the advantages from which large banks and insurers benefit through modelling their own capital requirements.   • HMT: Reform of the Consumer Credit Act

    HMT has announced that the Government will move much of CCA from statute to sit under FCA in order to enable... the regulator to quickly respond to emerging developments in the consumer credit market, rather than having to amend existing legislation. The reforms will build on the recommendations of FCA’s retained provisions report and the Woolard Review. A consultation is expected to be published by the end of this year which will outline the Government’s proposals.

  • FCA: “Dear CEO” letter: The rising cost of living – acting now to support consumers

    FCA is writing to more than 3,500 lenders to remind them of the standards they should meet as consumers across the... country are affected by the rising cost of living. FCA is concerned that some customers in vulnerable circumstances are not getting the support they need and that lenders are not discussing the potential benefits of money guidance or free debt advice or helping and supporting borrowers to access these. FCA notes that such concerns were seen broadly across the sector and that more serious failings were found at more than 30 firms, largely in the consumer credit sector. FCA has also published a webpage with regard to ensuring the fair treatment of customers in vulnerable circumstances.
