This follows a December 2012 consultation and provides the... full text of the final guidelines which will be translated into the official languages of the EU, and then published on the ESMA website. The deadline for reporting requirements will be two months after the publication of the translations and the guidelines will apply from such date.

  • European Parliament: Barnier debate highlights next steps for banking union/resolution

    This pres release notes that Economic and Monetary Affairs Committee MEPs have questioned Michel Barnier on his proposals for resolution plans,... planned legislation on shadow banking and insurance, It was confirmed that the EC would propose a single resolution authority to deal with banks in trouble and that the authority "will do more than just coordinate work between national authorities. We have seen the limits of coordination”, adding that he did not believe a change to the treaties was required for the system to be set up, but “acknowledged that German worries were understandable and that a treaty change could be envisaged at a later date, to perfect a banking union that would be already up and running”.

He urges a “renewed and enhanced effort” for the single... rulebook; convergence in supervisory practices and cooperation between authorities and a framework for cross-border bank resolution, However, he also notes: “repairing the Single Market, and avoiding a rift between Member States that will join the SSM and those that will not, requires that a number of additional steps are taken, all strengthening other components of the European System of Financial Supervision (ESFS), for which at the moment I do not see the necessary political commitment”.

  • ESMA: Speech by Steven Majoor: ESAs – achievement and challenges (24 May 2013)

Among the challenges cited: supervisory convergence; the balance between supervision... and regulation; consumer protection and the funding model of the ESAs. He concludes: “when the ESFS was established an important question was whether the new system was sufficiently different from the existing system of the three Level Three Committees. Having worked in the new environment for more than two years, the answer is clear to me that there has been a fundamental change. However, considering the even more severe conditions in financial markets, we should raise the bar and ask the question whether that fundamental change is sufficient and whether further improvements are needed”.
