  • HMT: Insurance Bill

    HM Treasury announced that the Government has placed a Bill before Parliament which would increase certainty in aspects of insurance contract... law. In particular, reforms include: -a duty of “fair representation” on business policyholders disclosing risk information to insurers, with liability for breach of this duty; -“basis of the contract” clauses, which convert precontractual information supplied to insurers into warranties, are abolished. Also, in the event of breach of warranty, insurers’ liability is suspended rather than discharged (and so coverage will be restored after the breach has been remedied). -new remedies are provided against policyholders submitting fraudulent claims.

  • CMA: Consultation: personal current accounts and banking services to small and medium-sized enterprises: Provisional decision on market investigation reference

    The CMA has provisionally determined that there are reasonable grounds to suspect certain factors are preventing, restricting or distorting competition in... the SME banking and personal current account sectors. The regulator has rejected banks’ proposals for ‘undertakings in lieu of a reference’, whereby they would voluntarily accept certain behavioural reforms in the SME banking sector in return for avoiding a market investigation, and the CMA is now consulting on whether it should make a market investigation reference. The CMA notes that it “cannot rule out the possibility that structural remedies may be necessary” – which could include forced divestment and breaking up banks. Responses to the consultation are required by 17 September 2014 and the CMA expects to make its final decision on whether or not to make a market investigation reference “later in the autumn”. The CMA also published a joint FCA-CMA market study on SME banking and an update to its 2013 market study on personal current accounts, both of which form part of the background to the consultation.

  • The Financial Services and Markets Act 2000 (Regulated Activities) (Green Deal) (Amendment) Order 2014/1850

    This Order relates to the green deal energy efficiency scheme established by Chapter 1 of Part 1 of the Energy Act... 2011. It makes amendments to the RAO. In particular, it makes provision as to the circumstances in which a green deal plan is a credit agreement for the purpose of the RAO and the persons who are to be treated as being the lender and borrower in relation to a green deal plan. Article 12 makes provision as to the application of the provisions of CCA to a green deal plan which is made in the period starting with 1 April 2014 and ending with the date on which this Order is made, and which is not a regulated credit agreement when made, but becomes regulated when this Order comes into force. It disapplies certain provisions of CCA in respect of these green deal plans. It also clarifies the way in which, after this Order comes into force, certain provisions of CCA will apply in respect of these green deal plans. (Date in force: 15/07/14)
