  • FCA: CP22/24: Broadening access to financial advice for mainstream investments

    FCA has set out proposals for a new core investment advice regime. The aim is to allow firms to provide mass... market consumers with straightforward financial needs greater access to simplified advice on investing into mainstream products, specifically within stocks and shares ISAs. FCA also aims to provide clarity on some common areas of concern raised by industry stakeholders, including in relation to flexibility in the suitability requirements, and whether marketing to a target audience constitutes advice (see chapters 4 and 8). Responses are required by 28 February 2023. FCA intends to publish a final policy statement and finalise rules and guidance in spring 2023, targeting implementation of the regime before the end of the 2023/24 financial year so firms will be able to start offering core investment advice from the beginning of April 2024.

  • PRA: Basel 3.1 standards

    PRA’s CP16/22 sets out proposed rules and expectations that cover the parts of the Basel III standards that remain to be... implemented in the U. The CP also includes revised criteria for determining which firms would be in scope of the future “strong and simple” regime. PRA intends to consult on the first batch of measures that will apply to simpler-regime firms in early 2023 and will consult separately on simplifying remuneration requirements for Material Risk Takers at small firms that were introduced as part of CRD V and which apply additional remuneration rules to Material Risk Takers at these firms than under the previous UK regime. PRA’s proposed implementation date for the changes resulting from this CP would be 1 January 2025, with transitional arrangements that give firms significant time to adjust to the new framework. Responses are required by 31 March 2023.

The statement also calls on trustees investing in leveraged LDI to improve their scheme’s operational governance. FCA states that it expects asset managers to take any necessary or appropriate action following these communications an notes that it is reviewing lessons learned and engaging with firms on their operational contingency planning.
