ADSp 2016 - German Freight Forwarders’ Standard Terms and Conditions
In mid-December 2015, after several years of preparatory work, the German Association of Freight Forwarders (Deutscher Speditions- und Logistikverband e. V. – DSLV) published an updated version of the German Freight Forwarders’ Standard Terms and Conditions (Allgemeine Deutsche Spediteurbedingungen – ADSp). The updated version is recommended for use as standard terms and conditions as of 1 January 2016, and is thus referred to as “ADSp 2016”.
The official copy of the ADSp 2016 (in German) can be obtained from the DSLV website: http://www.dslv.org/dslv/web.nsf/id/pa_de_adsp.html.
The ADSp are by far the most frequently used terms and conditions in the German transport and logistics market. Most market players are very familiar with the former version of the ADSp, which dates back to 2003. This brochure is not a full summary of or even commentary on the ADSp 2016; it is intended as a brief introduction to the relevant features of these terms and conditions, compared with the established and widely used ADSp 2003.
The overall structure of the ADSp has been retained. A short preamble is followed by 30 clauses. As such, the overview below follows the structure of the old and new ADSp.
