Ukraine enacts law on introducing information and telecommunication system for pre-trial investigations

On 16 June 2021, the Law of Ukraine No. 1498-IX On Amendments to the Criminal Procedure Code of Ukraine Concerning Introduction of the Information and Telecommunication System of Pre-Trial Investigation came into force.

The relevant amendments establish the legal framework for a participant in a criminal proceeding to use an information and telecommunication system for the pre-trial investigation. Within this framework, the System will:

  • allow for the creation, collection, storage, retrieval, processing and transfer of materials and information for criminal proceedings;
  • allow participants in criminal proceedings access to materials stored in the System;
  • enable materials of the pre-trial investigation to be provided in electronic form;
  • recognise documents signed with an electronic signature as originals.

We believe that these changes will improve the efficiency of the criminal process and provide for more effective interaction between the parties during proceedings.
The System will go into operation on 15 December 2021.
