Bulgaria adopts Directive 2018/975/EU on posting of employees

On 22 January 2021, the Bulgarian parliament passed an amendment to the Ordinance on the terms and procedures for posting and secondment of workers and employees within the framework of the provision of services in line with the core requirements of Directive 2018/957/EU.

The main changes include:

  • Introduction of long-term posting
  • Working conditions
  • Salary conditions
  • Housing requirements
  • Costs for travel, food, and accommodation in case of re-posting
  • Applicable law in case of violations

If the posting of the employee is determined to be invalid, all conditions and requirements of Bulgarian law, which are more favorable to the employee than those provided for in the legislation of the 'sending' country, would apply to the employment relationship.
