Bulgaria: Court vacation, postponement may be introduced due to COVID-19

On 10 November 2020, the Judicial Board of the Bulgarian Supreme Judicial Council adopted a decision on the existing Rules and measures for the work of courts during the COVID-19 pandemic, which gives the administrative heads of courts sole decision-making powers on postponement of scheduled cases, cancellation of open hearings and whether to handle only urgent cases for a certain period because of the worsening epidemic situation and large number of infected magistrates.

According to the law, only certain cases are considered urgent, particularly criminal ones in which a remand in custody measure has been issued; bankruptcy cases; maintenance cases for parental rights of minor children and for illegal dismissal; requests for securing claims, securing evidence, issuing permits and orders under the Family Code, such as appointing a special representative, adoption of a child and others.

Each court must publish an order of the introduced measures on its website.

These rules will be valid until the promulgation in the State Gazette of amendments to the Law on Measures and Actions during the State of Emergency, declared by a decision of the National Assembly of March 13, 2020, and to overcome the consequences that allow introduction of one court vacation for a period not longer than 14 days.
