New Public Procurement Law signed by the President of the Republic of Poland

Work on the new Public Procurement Law has been completed.

Following its adoption by the Parliament on 11 September 2019, the regulation was brought before the Senate, which adopted the Act without any amendments. On 14 October 2019 the Act was signed by the President of the Republic of Poland, and thus the legislative process was concluded. At present the Act, along with the accompanying Act containing the implementing provisions, is awaiting formal publication in the Journal of Laws of the Republic of Poland.

The new Public Procurement Law contains a number of solutions which have a material impact on the situation of contracting authorities, contractors, and subcontractors. Such solutions are to be a response to the current problems on the Polish public procurement market, including, among other things, low competitiveness, an imbalance between the parties to the public contract, and no flexibility at the stage of performing the contract.

The regulation will enter into force on 1 January 2021, i.e. after a vacatio legis period of over one year. We will discuss the changes arising from it in greater detail in subsequent articles.
