Insolvency refresher and counterparty insolvency – Part 1

United Kingdom

This article was produced by Olswang LLP, which joined with CMS on 1 May 2017.

Across two webinars, recorded by Olswang LLP on 12 October 2016 and 18 October 2016, Partner Julian Turner, Senior Associate Emma Bardetti and Associate Caroline Dodman offer a refresher on insolvency and counterparty insolvency.

The first session considers:

  • Administration, including looking at how an administration commences, what the main features of the process are and how it affects existing contracts;
  • Self-help measures that may be contractually agreed at the outset of a relationship to limit the detrimental effects of counterparty insolvency; and
  • Immediate steps to be taken to protect yourself once you become aware of counterpart insolvency, including discussion of the interests of relevant stakeholders and funding and acquisition.
