An energy court for Scotland?

Lord Gill, Scotland’s most senior judge, speaking last week about the current programme of reform of Scotland’s courts said:

“The opportunity that our natural resources present should be served by the court system.”

As part of the reforms, and following the success of the commercial court in the Court of Session, Lord Gill intends to launch a feasibility study into the creation of an Energy and Natural Resources Court in Scotland to provide a specialist forum for litigations in these fields.

Lord Gill proposes that the Energy Court would be part of the Court of Session in Edinburgh, but would be able to sit in other centres, such as Aberdeen and Glasgow as necessary. He emphasised that Scotland has a wealth of skilled judges and lawyers and therefore his ambition is to create a court of international renown that will make its own contribution to Scotland’s prosperity.

This announcement comes in light of a growing commitment to renewable energy in Scotland and internationally and would allow the Scottish legal system to drive economic progress in Scotland.
