Poland: new online procedure for money claims

A new online procedure for money claims has been launched by the Ministry of Justice.

The procedure requires claimants to complete and file a simple electronic statement of claim at www.e-sad.gov.pl

In the first two months since its launch on 1 January 2010, almost 70,000 claims have been registered. The e-court, based in Lublin, in Eastern Poland, has reached a decision in 48,953 cases, issuing writs of payment in 98% of them.

The new procedure:

· aims to expedite the procedure for writs of payment
· is intended to relieve an overloaded court system, as well as easing the work of debt collection agencies and telecoms and utility companies
· is trialling the use of modern technology in civil litigation in Poland
· is partly based on the UK’s Money Claim Online system
· does not require a certified electronic signature, except for documents issued by the court, as the parties’ identities are verified at other stages of the procedure
· enables a reduction in court fees (to 1.25% of the value of the sum in dispute) and other expenses
· follows a different procedure to traditional ‘paper’ proceedings, for example in only requiring statements of claim to state the evidence and powers of attorney rather than attach copies
· requires all court files to be held in digital form and made available online to the court and parties, with bailiffs having online access to enforcement titles
