Slovakia: new rules for waste management businesses

From 1 November 2009, waste management businesses face extra responsibilities in relation to:

  • cross-border waste transport
  • disposal of batteries and accumulators
  • sorting degradable waste
  • free repurchase and recovery of electronic waste
  • reuse, delivery and processing of electronic waste
  • registration and entry into all statutory records and registers (in some cases within 3 months of 1 November 2009).

Businesses failing to meet these deadlines may be fined up to €165,969.59.

The definition of ‘producers’ has also been extended. For instance, a producer of electrical equipment includes anyone whose business includes importing or exporting electrical equipment within the EU.

Similarly, a producer for the purpose of battery disposal includes anyone whose business includes marketing batteries or accumulators imported to the Slovak Republic regardless of the sales technology, including batteries and accumulators as part of equipment or motor vehicles.

Producers are also required to register with the Recycling Fund (and to pay a contribution) within 30 days of starting to produce or import batteries or accumulators. Existing producers when the change came into effect thus had to register by the end of November 2009.

Waste management businesses which collect used automobile and industrial batteries and accumulators or perform repurchasing of electronic waste are also now required to register with the competent authority.
