The Court of Appeal finally delivered its judgment in the Attheraces/British Horseracing Board case and allowed the BHB's appeal. Subsequently to the judgment, the parties reached a settlement under which Attheraces agreed not to take the appeal to the House of Lords and this has removed one of the remaining obstacles to the establishment of the new British Horseracing Authority. The sole remaining hurdle (click here to view our previous report) is resolving responsibility for the pension liabilities of those employees who will transfer to the BHA. In the meantime, however, Paul Roy the BHA Chairman has become Chairman of the BHB in place of the retiring Martin Broughton.
