Spectrum goes to the House of Lords

Those of you who have been following the progress of Re Spectrum Plus Limited through the courts will be interested to hear that the Court of Appeal yesterday gave leave to appeal to the House of Lords.

It will be the House of Lords who will finally determine whether the charge in the bank's debenture over Spectrum Plus Limited's book debts creates a fixed or a floating charge.  In May, the Court of Appeal reversed the first instance decision and found that the charge was fixed and not floating.  For a summary and commentary on the Court of Appeal judgment click here.
