Parallel imports judgment due on 6 February

Mr Justice Laddie's judgment in the long running case of Boehringer Ingelheim & others - v- Swingward & others is due to be handed down on Thursday 6 February 2003. The case, concerning the extent to which parallel importers may repackage pharmaceutical products, was referred to the European Court of Justice which gave judgment in April last year. At a hearing in December 2002 both the pharmaceutical companies and the importers argued that the European Court's judgment should be applied in their favour. It is hoped that Laddie J's forthcoming judgment will clarify this area of law and bring an end to the considerable uncertainty over repackaging issues.
