Stephen Byers accepts ice cream undertakings

United Kingdom

On 7th April 2000, Stephen Byers announced that he had accepted further undertakings from Birds Eye Wall's and from Nestlé and Mars in connection with the Impulse Ice Cream Monopoly Report.

The outlet exclusivity undertakings given by Walls, Mars and Nestlé will apply with effect from 29th January 2000. As of that date these companies undertake not to enter into or renew outlet exclusivity agreements with shops. They may enter into exclusivity agreements with single mobile vans or seasonal kiosks until the end of 2002, provided that these agreements do not apply to all outlets on a single site.

The undertakings from Birds Eye Wall's on freezer exclusivity and retrospective discounts for retailers came into effect on 15th April. From that date Birds Eye Wall's is no longer able to reserve more than 50% of the freezer display for its products, and none of the freezer storage space.
