UK: Water charges 2

Further to OFWAT’s draft price limits announced on 27 July 1999 (please see July 1999 Environment Law Bulletin), Ian Byatt has announced that the final price determinations will be announced on 25 November 1999.

The DETR has issued a draft guidance to the Director General of Water Services on water company charges for consultation. The guidance applies to charges for both household and non-household services, although many considerations primarily affect households. The Government has taken into account comments made during the 1998 consultation paper , “Water Charging in England and Wales - a New Approach” and has also taken account of issues raised during Parliamentary Debates on the Water Industry Act 1999 which received Royal Assent on 30 June 1999. The key objectives addressed are that the framework of water charging should provide a fair distribution of costs between customers, recognising the affordability of the service for different groups of customers. Companies’ charging schemes should also take account of the impact of water use on the environment, stability should be reflected in charges for customers whose water use does not change markedly between years and charges should be clear and transparent. Section 4 of the Water Industry Act 1999 provides that the Director General of Water Services must have regard to the DETR’s guidance.
