“Proposals for the Biocidal Products Regulations (BPR) and Approved Code of Practice on test methods for data submitted under the BPR” has been issued for consultation by the Health and Safety Commission. The Biocidal Products Regulations will implement the EU Directive on Biocidal Products (98/8/EC) which is designed to provide a high level of protection for humans and the environment and harmonise the European market for biocidal products. The new Regulations will be phased in over a ten year period and will ultimately replace the existing controls on non-agricultural pesticides under the Control of Pesticides Regulations 1986. These Regulations and guidance will be supplemented by further guidance which, as a package, explain the new biocides regime. Further guidance is therefore expected on: the transitional arrangements; advice for applicants seeking authorisation of biocidal products under the Regulations; and a simple guide to the Regulations. The Regulations implement the EU Directive, but do not impose stricter conditions. The Regulations are expected, over time, to treble the number of products subject to specific controls by including many which are currently only subject to general chemicals legislation, disinfectants being one example.
