European Commission Directive 99/77/EC adapting to technical process for the sixth time Annex I to Council Directive 76/769/EEC on the approximation of the laws, regulations and administrative provisions of the Member States relating to restrictions on the marketing and use of certain dangerous substances and preparations (asbestos) was published in the Official Journal of the European Communities on 6 August 1999. The Directive requires Member States to ban the use of chrysotile (white) asbestos by 1 January 2005. The only exception is for diaphragms for existing electrolysis installations until they reach the end of their service life, or until suitable asbestos-free substitutes become available. This derogation will be reviewed before 1 January 2008. The Annex to the Directive also states that where asbestos fibres are already installed and/or in service before the implementation date of this Directive, its use shall continue to be authorised until products are disposed of or reach the end of their service life.
