R v RG Construction Management Limited (29 April 1999) Magistrates' Court

The Environment Agency brought a charge under Sections 85(1) and 85(6) the Water Resources Act 1991 against RG Construction Management Limited for causing chalk silt to enter the River Chess at Chesham. The company was engaged in the removal of water from an old excavation and believed that it was pumping clean groundwater into a watercourse leading to the River Chess. The company had struck a seam of mixed gravel and chalk which had turned the river milky white due to the high level of suspended chalk solids. There were no measures put in place to prevent this. R G Construction Management Limited pleaded guilty to the charge and was fined £12,500 and ordered to pay £892.50 in costs.
