Revision of the Brussels Convention 1968

United Kingdom

The Working Party on the Revision of the Brussels and Lugano Conventions has agreed a number of amendments to the Brussels and Lugano Conventions. The amendments were agreed by the Council of Ministers on 28th May 1999.

No agreement has been made to adopt this as the "new" text of the Brussels Convention, because the Commission is about to introduce a draft Regulation which will replace the Convention. It is expected that the proposals set out by the Working Party will be incorporated into the new Regulation. The Commission is expected to present the draft Regulation in the near future, but any negotiation on the amendments will not take place until at least the Autumn. At the moment, the UK Government's view is that complicated issues will arise by trying to replace the Convention with a Regulation, so negotiations may well be drawn out.
