Water pollution: R v Anglian Water Limited (13 October 1998) Magistrates Court

In October 1997 the Environment Agency conducted a biological survey of the Louth Canal. The Environment Agency found the water to be bright green with potentially toxic algae. This was traced back to a discharge from the overflowing lagoons at Anglian Water Limited's Covenham water treatment works. Charges were brought against Anglian Water Limited by the Environment Agency under Section 85 of the Water Resources Act 1991 for causing polluting matter to enter controlled waters. Anglian Water Limited pleaded guilty and was fined £5,000 with costs of £1,578. The Environment Agency was also obliged to warn members of the public and river users that blue-green algae was present. (ENDS Report 285, p52)
