Waste: R v Barney (20 October 1998) Magistrates' Court

John Ernest Barney operated a skip hire company.

After collecting the waste in question, Mr Barney deposited it illegally in his own backyard instead of taking it to a licensed site for proper disposal. The Environment Agency brought proceedings against Mr Barney for contravention of Section 33 of the Environmental Protection Act 1990. He was found guilty by the court of keeping controlled waste without a waste management licence and was sentenced to 120 days imprisonment, 60 days to be served immediately and 60 days to be suspended for twelve months.
