Illegal copying of decoding equipment and smart cards is severely threatening the existence of encrypted satellite channels (pay channels). To remedy this Denmark plans to make unauthorised copying of decoder equipment and smart cards a criminal offence.


The legislation is a mirror image of the EU Directive on Encrypted Services. It has the same weakness: it only covers possession and use for business purposes, not a private end user's purchase and possession of the pirated material.

An interim injunction has been obtained against a person downloading recorded music from the Internet. The importance of the decision is that the Court acknowledged the record producer's exclusive right to permit or forbid transmissions through the Internet. Use of a thirty seconds excerpt of a record track was not accepted as a free use under the so-called "quotation rule".
