Pensions Act 1995

  • The Pensions Act has been covered in previous Bulletins, but it should be noted that the bulk of the Act not already in force only came into force on 6 April 1997.
  • Those provisions still to be brought into operation are sections 48(7)-(13) (sanctions for failing to whistleblow), section 91(3) (exclusion of occupational pension rights from the member's assets on bankruptcy), section 95 (recovery of excessive pension contributions on bankruptcy) and section 145 (extension of income withdrawal to occupational schemes).
