Liability of insurer as administrator 1

A subsidiary of an insurer was held to be an "administrator" for the purposes of the Ombudsman's jurisdiction. This was on the grounds that the tasks which it performed included maintaining membership records, producing actuarial reports, advising on reduction of surplus, calculating and arranging payment of transfer values, liaising with the tax office and preparing documents for signature by trustees. The Ombudsman held the administrator and the trustees jointly and severally liable for GBP 225,500 plus interest.
