Shorter notice periods for early part of employment contracts

The Act of 26 March 2018 regarding the strengthening of economic growth and social cohesion was published in the Belgian official journal on 30 March 2018.

This Act modifies notice periods for termination of an employment contract by the employer during the early part of a contract of indefinite duration. It provides a more progressive structure for notice periods during the first six months of employment. However, notice periods for resignation remain unchanged.

The Act will enter into force on 1 May 2018 and will provide the following notice periods for termination by the employer:

  • 1 week for employees with less than 3 months’ seniority
  • 3 weeks for employees with between 3 and four months’ seniority
  • 4 weeks for employees with between 4 and 5 months’ seniority
  • 5 weeks for employees with between 5 and 6 months’ seniority.


The notice periods for employees with more than six months’ seniority have not been modified.
