English court issue fees now as high as £10,000

The increased cost of issuing money claims in the English courts has now taken effect. From now on the issue fee will represent 5% of the value of the claim, subject to a cap of £10,000 (see recent Law-Now for more detail).

The rise in fees has come into effect sooner than expected following the tabling of a Motion of Regret and lively debate in the House of Lords on Wednesday, 4 March.

On 22 February 2015, the Law Society issued a pre-action protocol letter for judicial review to challenge the government’s decision to raise court fees (see recent Law-Now for more detail) and there is widespread concern that the fee increase will result in the denial of access to justice for individuals and companies who take the decision not to pursue claims on the basis of the significantly increased issue fees.
